BACKGROUND CHECK REQUIREMENTS

THIS REQUIREMENT APPLIES TO ALL DOT MODES:  PHMSA (pipeline), FMCSA (motor carrier/CDL holders), USCG (coast guard), FAA (aviation), FRA (railroad) and FTA (transit).

 

Beginning August 1, 2001, the Department of Transportation will require that any company hiring employees or transferring employees into DOT safety-sensitive positions must perform a background check for any misuse of drugs and/or alcohol in the previous two (2) years from the employee’s previous employer(s).  Any new employee or transferring employee must also complete and pass a pre-employment drug test.

49 CFR Part 40.25 – An employer must, after obtaining an employee’s written consent, request the information about the employee from DOT-regulated employers who have employed the employee during any period during the two years before the date of the employee’s application or transfer.  If feasible, the information must be obtained and reviewed before the employee first performs safety-sensitive functions.  If not feasible, the employer must obtain and review the information as soon as possible.  However the employer must not permit the employee to perform safety-sensitive functions after 30 days from the date on which the employee first performed safety-sensitive functions, unless the employer has obtained or made and documented a good faith effort to obtain this information.  If the employer obtains information that the employee has violated a DOT agency drug and alcohol regulation, the employer must not use the employee to perform safety-sensitive functions unless the employer also obtains information that the employee has subsequently complied with the return-to-duty requirements of the DOT drug and alcohol regulations.

NOTE:  Conducting a background check on any new employee or transferring employee that will perform DOT safety-sensitive work is mandatory.  You only need to request the information if the employee has performed DOT safety-sensitive work for a DOT regulated employer during the last two years.  So, if the employee has not performed DOT safety-sensitive work in this last two years, you just need to document that the employee did not perform DOT functions.
